About these terms
Boostkit is provided by Matt West, trading as Boostkit through West Media Limited (company number 15405002, VAT number GB511032558, registered office 29 Prospect Road, Southborough, Tunbridge Wells, England, TN4 0EN). In these terms "I" means Matt West acting for West Media Limited, and "you" means the client business and each person who signs in for it.
By signing in you agree to these terms. If I have a separate written agreement with your business, that agreement comes first wherever the two differ. What I charge is set out in that agreement, not here.
These terms are for the people who sign in. Customers who use a booking page, a form or an invoice page are dealing with the business that sent them the link, on that business's own terms.
Your account
- Access is by invitation. I set up each client's account and the client decides which of its staff are invited and what each may do.
- Sign in only as yourself, with the email address you were invited at. Do not share a sign-in.
- Keep your email account and your devices secure, and tell me straight away if you think someone else has got into your account.
- Tell me, or remove them yourself under Settings, Team, when someone leaves your business and should no longer have access.
Your data and your customers
The records in your account belong to your business. You are the controller of your customers' personal data and I handle it for you as your processor, as set out in the privacy notice. You are responsible for:
- having a lawful reason to hold each customer's details, and telling your customers how you use them in your own privacy notice;
- only sending marketing emails and texts to people who have agreed to receive them, and honouring every unsubscribe;
- taking extra care with anything about a person's health, and collecting no more of it than you need;
- answering your customers' requests to see, correct or delete their data. I will help when you ask.
You agree that I may open your account to set it up, to support you and to fix problems, and that in doing so I may see the data in it, including data from accounts you have connected. I do not use it for anything else.
Connecting other services
You can connect accounts you hold with other services, such as Google, Facebook, Microsoft and Stripe. When you do, you confirm that you are allowed to connect that account and you authorise Boostkit to act on it for the features you switch on: for example to read your reviews and send the replies you write, to publish the posts you schedule, to receive your leads, and to add appointments to a calendar.
- Each service has its own terms, which you must keep to. I am not responsible for a service changing, limiting or withdrawing what it offers.
- Nothing is posted, replied to or sent on a connected account unless someone in your business has written it or set up the rule that sends it.
- You can remove a connection at any time under Settings, Connections.
- If you create an API key and connect your own tools, you are responsible for what those tools do with your account.
Google Maps features and content
Boostkit includes Google Maps features and content: the business lookup I use when I add a client, and a review widget that shows Google's own selection of a business's reviews, on the pages where you choose to use it. Use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service (the Google Maps End User Additional Terms of Service) and the Google Privacy Policy.
If you put that review widget on your own website, your website's terms must tell its visitors the same, and you must not show the widget with or near a map that is not Google's.
Taking payments
Card payments for deposits and invoices are taken through your own Stripe account. You are the seller, the money goes to you, and Stripe's terms apply between you and Stripe. I am not a party to the sale, I do not hold your customers' money or card details, and refunds and disputes are handled by you in Stripe.
What you must not do
- Use Boostkit to break the law, or to send spam, misleading or harassing messages.
- Upload data you have no right to hold, or data bought or scraped from elsewhere.
- Try to reach another client's account, get round the access controls, or probe the service for weaknesses without my written agreement.
- Copy, resell or give others access to the service, other than the staff you invite.
- Overload the service, for example by automated requests far beyond normal use.
The service
I work to keep Boostkit available and correct, and I fix faults as quickly as I can, but I do not promise that it will always be available or free of errors. Features change over time; I announce changes that matter under What is new in the app.
Boostkit helps you run your business. It does not give legal, tax, medical or data protection advice, and you remain responsible for the decisions you make with it and the messages you send from it.
Responsibility if something goes wrong
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Beyond that, the limits on what each of us is liable to the other for are those in my written agreement with your business.
Ending and leaving
- Your business can stop using Boostkit at any time by telling me.
- I may suspend or end access if these terms are seriously or repeatedly broken, or if I must to protect other clients or comply with the law. Where I can, I will tell you first.
- Before your account is closed you can ask for a copy of your data.
- After it is closed, the account and everything in it are deleted within 90 days. The data deletion page explains what is deleted and what the law may require to be kept.
Changes to these terms
I may update these terms. The date at the top changes when I do, and if a change matters to how you use Boostkit I will tell you in the app or by email before it takes effect.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales decide any dispute.
